(Which they then leave on the screen for days after the story breaks…really?) “The FTC bans non-competes!” Being both an American and a recruiter, you make huge assumptions and don’t read the fine print and ever since you saw the headline you’ve been telling clients and candidates… “Non-competes are gone…no worries that my candidate has one.” or “These things are history, you can interview with competitors with impunity!” 

Not just wrong…Dangerous…as in Legal Liability Exposure dangerous…

So in this session we’ll bring you up to speed on the history of the FTC’s move to ban non-competes, what is actually happening, and when there will be a change… (There will be for sure!)

We’ll also review Best Practices on Non-competes:

• When and how in the process to disclose the non-compete
• The proper protocol for advising a candidate on how to handle the non-compete
• A complete understanding of both your exposure and your candidate’s
• How to handle “I have to show this to Legal”
• Verbiage candidates can use when they resign to avoid being held to their non-compete

Remember it was years after the Pay Equity Act was advocated before it became law (in some states) …remember that this is an election year and depending on the outcome, the whole FTC initiative could be thrown out or delayed. Meantime, we need to know how to handle an essential and provocative part of the placement process…
